Bonding Improvements for Development

Prior to Final Plat approval either the required improvements must be complete or financial guarantees are obtained.

Financial Guarantees

An applicant can provide a bond or LOC in a form acceptable to the Town.  The financial security shall be 1.25 times the cost of the improvement.

• The town engineer shall review the engineered stamped estimate and provide comments. 

• The town engineer shall approve the bond estimate via email. 

• The bond or LOC shall not expire.

The original bond or LOC must be received prior to recording a final plat.

Completing Improvements

Upon completion of improvements, an inspection is required by Town staff and other relevant agencies. The list of improvements are as follows (this list may not be all inclusive depending on the type of project):

• Street Trees (LA/Arborist)
• Lighting
• Curb and Gutter
• Asphalt within the Right of way
• Detention Ponds
• Grass/sod
• Signage and Pavement Markings
• Trail and sidewalk installation
• Open Space landscaping required (LA/Arborist)

Financial  Reduction and Release

Once inspections have occurred a letter from the applicant asking for a release or reduction in the bond or LOC amount is required. Only one reduction is allowed per phase.  The letter is to include the bond issuance date, bond number and requested amount to be released. Prior to release the following items are required:

•  As-builts for the complete storm system, catch basin locations, and inverts / pipe sizes to match plans.
• GIS layer to upload information into the town database
• A stamped engineers estimate brought down to $0 (or reduction number)
• Erosion control close out information

Failure to Comply

Should the applicant fail to complete the required improvements, the applicant shall pay all or any portion of the bond or escrow fund to the Town of Waxhaw up to the amount needed to complete the improvements. . The applicant shall at all times bear the financial burden for the installation of all required improvements.
